Supreme Court says to Uddhav Thackeray you resigned and ran away to confidence motion

After hearing last year’s rebellion in Shiv Sena, the Supreme Court has reserved its verdict on the petitions filed for Uddhav Thackeray’s visit. An interesting debate was also witnessed on this matter on Thursday. Meanwhile, the Supreme Court also commented on the demand to restore the Uddhav Thackeray government. The court said that when Uddhav Thackeray himself had resigned as CM and did not even face the trust vote, then how could his government be restored. The Supreme Court said that even if the Governor is at fault in this matter, Uddhav Thackeray’s government cannot be restored.

In fact, during the hearing, the Uddhav Thackeray government had mentioned the Arunachal Pradesh case of 2016. The Supreme Court then reinstated Nabam Tuki’s government and issued a status quo order. Advocate Kapil Sibal, representing the Uddhav Thackeray faction, had demanded from a 5-judge bench that the floor test order of the then Governor Bhagat Singh Koshyari be quashed, before which Uddhav Thackeray had resigned. Earlier on Wednesday, the Supreme Court had raised questions on the decisions of the governor and said that Shiv Sena’s split was an internal matter of the party.

The decision of the government on the basis of this was wrong and the decision of the governor was like interfering in the political matter, which he should not have done. Abhishek Manu Singhvi also raised the demand for the restoration of the Uddhav government. To this the bench said, ‘According to you what should we do? Should your government be reinstated? But you resigned. Now the court is being demanded for the restoration of that government, which had relinquished power without facing the floor test.

What was the matter of 2016, which was mentioned by the Uddhav group

Kalikho became the full CM in Arunachal Pradesh in 2016 with the support of the BJP. Due to this, Nabam Tuki had to step down. When this matter reached the Supreme Court, it ordered status quo and reinstated the old government. Referring to this, Abhishek Manu Singhvi said that if the governor’s decision is declared illegal, then Uddhav Thackeray’s resignation will become irrelevant.

Debate lasted for 9 days, veteran lawyers kept arguing

The top court heard the arguments of the Uddhav Thackeray group and the Eknath Shinde group for 9 consecutive days during the hearing and has now reserved the verdict. During this, veteran lawyers like Kapil Sibal, Abhishek Manu Singhvi, Devdutt Kamat and Amit Anand Tiwari were present to defend Thackeray. Apart from this, lawyers like NK Kaul, Mahesh Jethmalani and Mahinder Singh were present from the Shinde faction.
