In one of its important decisions, the Supreme Court said that it has given an important decision in the case of flat owners and builders. The court said that even after taking possession of the apartment, the consumer does not lose his right against the promises made by the builder regarding the amenities. The Supreme Court said that sometimes due to circumstances flat owners take possession of their apartments. During this many times the promises made by the builders are not fulfilled. But even after taking possession of the flat, the owners do not lose their rights which were promised to them by the builders.
Supreme Court’s comment
The judgment has been pronounced by a bench headed by Supreme Court Justice S Ravindra Bhatt. Actually an appeal was filed in the Supreme Court against the decision of the Consumer Forum. The matter has again been sent to the Consumer Forum for hearing. Explain that the National Consumer Forum, while rejecting the appeal for compensation filed by the flat owners, had said that they have taken possession of the flat.

The Supreme Court, while criticizing the careless decision of the National Consumer Forum, said that they should understand the reality of the present times. The Supreme Court said that in our opinion the Consumer Forum must have failed to understand the present reality. Flat buyers always buy flats on the basis of loans given by banks and other financial institutions. The owners of the flat enter into an agreement with the lending institution, due to which the installments of the loan start within a fixed time.
In such a situation, if the construction of the house is not completed, the flat owner is forced to take possession of it. Please tell that this case is of Kolkata where the flat owner had approached the Supreme Court against a builder.
